By accessing or using the Elective Genius platform ("Service") operated by Genius Learning, Inc., doing business as Elective Genius ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you are a parent or guardian creating an account for a minor, you agree to these terms on behalf of your child. If you are a school administrator, you agree on behalf of your institution.
Elective Genius provides AI-powered, self-paced high school elective courses designed for independent learners. The Service includes:

School accounts are available to accredited educational institutions and authorized homeschool cooperatives. The school administrator is responsible for:
Course content is generated and curated using artificial intelligence technology. While we strive for accuracy and alignment with educational standards, we recommend that parents, guardians, and educators review course content to ensure it meets their specific requirements.
Courses are designed to align with Common Core State Standards, Next Generation Science Standards (NGSS), and relevant state frameworks. Standards alignment is provided as a guide and may not satisfy every state's specific requirements. Families and schools are responsible for verifying compliance with their state's homeschool or educational requirements.
Elective Genius is not an accredited educational institution. Certificates of completion and transcripts generated by the Service are "unofficial" records. Acceptance of Elective Genius coursework for academic credit is at the sole discretion of the receiving institution (school, college, or university). We make no guarantees regarding credit acceptance.
Lessons may include links to external resources (videos, articles, tools). These resources are provided by third parties, and we are not responsible for their content, availability, or accuracy. We recommend parental review of external resources.
The AI tutor is designed to provide educational guidance and is not a substitute for professional instruction, counseling, or therapy. Meri may occasionally produce inaccurate information. Students and parents should verify important information independently. The AI tutor will not:

Pricing is subject to change. Founding members who signed up during the initial launch period retain their locked-in rate for life.
Family Plan and Family All Access include a 14-day free trial with full access. School licenses also include a 14-day free trial. Enter your card to start — you won't be charged until day 14. Cancel anytime before day 14 and pay nothing. Payments are processed by Stripe. Subscription plans renew annually and may be cancelled at any time through your account settings. Single Course and Career Pathway purchases are one-time and do not renew; they include a 30-day money-back guarantee (see Section 6.3).
Free trials. If you cancel within your free trial window (14 days for family plans and school licenses), no payment is collected and no refund is needed.
One-time purchases (Single Course $149, Career Pathway $499). You may request a full refund within thirty (30) days of purchase if you have completed fewer than three (3) lessons of the purchased course. Refund requests are processed within 5 business days. After the 30-day window, or once 3 or more lessons have been completed, refunds are not available. To request a refund, email support@electivegenius.com with your order details.
Annual subscriptions (Family Plan, Family All Access). You may cancel at any time through the “Manage Subscription” link in your Account Settings. Cancellation stops the next renewal; the current paid period remains active through its end date and is not refunded on a pro-rata basis.
School licenses. Refund terms for institutional contracts are specified in the school's signed institutional agreement and supersede this section.
Failed payments. If a payment fails after a successful trial, your subscription enters a grace period during which you can update your card via the billing portal. Repeated failures will result in subscription cancellation and loss of access until payment is restored.
All course content, platform design, and AI systems are the property of Elective Genius. Users may not copy, distribute, or reproduce course content outside the platform without written permission.
Students retain ownership of all original work they create (journal entries, project submissions, portfolio pieces). We have a limited license to store and display this work within the platform for educational purposes. Students and parents may export and use student work at any time.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We are not responsible for academic outcomes, credit acceptance, or college admissions decisions based on coursework completed through the Service.
You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination:
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court. Small claims court actions are exempt from arbitration.
We will notify users of material changes at least 30 days in advance via email and in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
